The higher–risk building regime—overview

After the Grenfell Tower tragedy, the government commissioned an independent examination of Building Regulations and fire safety legislation. Its concluding document, the Hackitt Report, was released on 17 May 2018, and tabled more than 50 proposals, among them creating a new regulator to supervise how buildings are constructed and managed. The Building Safety Act 2022 (BSA 2022), which secured Royal Assent in April 2022, formed a central plank of the government’s response to the Hackitt findings. BSA 2022 opened the door to sweeping reforms of building safety law. Parts 3 and 4 of BSA 2022 established the architecture for a regulatory regime covering ‘higher-risk’ buildings (HRBs) in England.
