Performance bonds broadly fall into two classes: default (conditional) bonds and on-demand bonds.
A performance bond is an agreement between a bank or insurer (the surety) and the employer, under which the surety assumes responsibility for the contractor’s obligations under the building contract. In UK construction, the bond sum is commonly set at 10% of the contract price.
The obligation to furnish a performance bond usually stems from a provision within the building contract and is often a precondition to the employer entering into that contract. A template bond is generally appended to the contract in a form acceptable to the employer.
