Within construction, framework agreements are commonplace: a framework agreement is an overarching arrangement that a party enters into with one or more suppliers (which may include contractors, sub-contractors, suppliers or consultants) and that sets the terms for a long-term relationship, within which the employer may award one or more contracts to those supplier(s). As its name indicates, it lays down the ‘framework’ for a strategic partnering relationship that may span from a light-touch understanding with one or several trusted suppliers through to a more formalised structure or arrangement. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential.
