Conclusions definition

What does Conclusions mean? In EU legal practice, “Conclusions” are formal statements adopted—most commonly by the European Council or the Council of the EU—setting out political priorities, common positions, or invitations to take action. They are used to coordinate Member State responses and to steer future legislation or implementation, but do not themselves create rights or obligations. Conclusions are a form of EU soft law. They are not among the legal acts listed in Article 288 TFEU and are not defined as binding in the Treaties, although the TEU recognises the European Council’s role in defining general political directions through its conclusions. Practice notes
imgtext

This Practice Note considers serious irregularity challenges in England and Wales where an arbitral award is tainted by fraud, or the award, or its procurement, offends public policy under section 68(2)(g) of the Arbitration Act 1996 (AA 1996). Where appropriate, it should be read alongside the Practice Notes: AA 1996—challenging the award on grounds of serious irregularity (s 68) and AA 1996—challenging the award—categories of serious irregularity (s 68).

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
