What does Statement of case mean? Documents that set out a party’s case in civil litigation: the written pleadings that define the issues for trial and the relief sought. In England and Wales, “statement of case” is a defined CPR term (r 2.3) and includes the claim form, particulars of claim, defence, reply to defence, any Part 20 claim (e.g. counterclaim or other additional claim), and any further information served under Part 18. This Practice Note explores the practicalities of making alterations to statements of case—covering amendments to Pleadings, particulars of claim, the claim form, the defence, and any reply—under CPR 17 in practice. It addresses how to indicate the changes that have been made, and in particular stresses the requirement to verify any amended Statement of case with a statement of truth (noting the risk of contempt of court where a statement of truth is untrue), and highlights the need to re-seal an amended claim form.
