Latest developments

On 16 February 2023, the Court of Justice issued its judgment. It held, amongst other things, that Article 101 TFEU must be read as not preventing national rules which stipulate that, where a claim is only partly upheld, costs are borne by each party, each bearing half of the common costs. Departing from Advocate General Kokott’s opinion, the Court clarified that any information asymmetry between the parties is not factored into the assessment of whether a national court may estimate the harm caused by the infringement.
