3G definition

What does 3G mean? In legal practice, 3G refers to third-generation mobile telecommunications networks and services, used in telecoms contracts, spectrum licences and regulatory documents to describe service capability, coverage and device compatibility. It is not a defined statutory term in the UK or Ireland; it is a descriptive industry expression aligned with the ITU’s IMT‑2000 family (including UMTS/HSPA). Typical uses include: specifying minimum service levels and coverage, defining permitted technologies in site and planning agreements, and setting roaming, interconnection and consumer service terms. Practical significance: 3G is now a legacy technology. Mobile operators in the UK and Ireland are progressively switching off 3G and...

Case facts Outline

Appeal before the General Court against the European Commission’s 2016 decision to block the proposed acquisition of Telefónica Europe plc by Hutchison 3G UK Investments Limited, taken under the EU Merger Regulation (Case M.7612).

Latest development

On 28 May 2020, the General Court handed down its judgment, upholding the action and annulling the Commission’s prohibition decision. The court set aside the prohibition.

  • The Commission’s analysis of unilateral (non-coordinated) effects contained multiple errors of law and appraisal and did not show, to a sufficiently high degree of probability, that prices would rise markedly.
  • The Commission did not establish that the transaction’s impact on network-sharing agreements and on mobile network infrastructure in the UK would amount to a SIEC.
  • The effects of the concentration on the wholesale market were not sufficient to demonstrate the existence of a SIEC.

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
