A caution against first registration

Within this Practice Note, a ‘caution’ denotes a device for safeguarding interests in land that is not yet registered. It does not itself bring an interest into being, nor does it alter the validity or ranking of any interest held by the cautioner. Instead, it prompts HM Land Registry (HMLR) to serve notice on the applicant for the caution—namely, the cautioner—whenever an application is made to register for the first time the legal estate relating to the land covered by the caution. This notification enables the cautioner, where there is reasonable cause, to challenge that first registration, if necessary.
