CDM Regulations definition

What does CDM Regulations mean? In practice, “CDM Regulations” describes the UK rules requiring health and safety to be managed throughout construction projects, from design to completion. In Great Britain, this means the Construction (Design and Management) Regulations 2015 (SI 2015/51); Northern Ireland has the Construction (Design and Management) Regulations (Northern Ireland) 2016 (SR 2016/146). In Ireland, broadly similar duties arise under the Safety, Health and Welfare at Work (Construction) Regulations 2013 (as amended), though they are not formally called “CDM”. CDM applies to all construction work (including refurbishment, maintenance and demolition). Key features include prescribed dutyholders (client, designer, contractor), the appointment of a principal designer...

Practice notes

For the purposes of the Construction (Design and Management) Regulations 2015 (the ‘Regulations’), contractors are the companies and individuals who undertake construction activities and works. Because this is a practical, site-based function, contractors are frequently the people most directly exposed to injury or harm to their health during everyday duties. The Regulations permit contractors to participate in planning, managing and Monitoring the construction work as required, as necessary. The Regulations adopt a broad description of ‘contractor’. It covers any person who manages or carries out construction work in the course of a business (including the self-employed). This can extend to parties who hold other key roles under these Regulations, such as the client or the Principal designer. A contractor may appoint several sub-contractors to carry out works. Each of those...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
