LDEDCA definition

What does LDEDCA mean? In practice, LDEDCA is the commonly used shorthand for the Local Democracy, Economic Development and construction act 2009, which reformed the statutory regime in Great Britain (England, Wales and Scotland) for construction payments and adjudication by amending Part 2 of the Housing Grants, Construction and Regeneration Act 1996 (HGCRA 1996). The acronym itself is not defined in legislation. Key changes included: removal of the “in writing” requirement so the HGCRA applies to oral construction contracts; a new payment framework (payment notices, default notices and the “pay less” notice); tighter limits on conditional payment clauses (including “pay when paid/certified” mechanisms); and...

This Practice Note details how Part II of the Housing Grants, Construction and Regeneration Act 1996 (HGCRA 1996) provisions on payment and adjudication in construction contracts were altered by the Local Democracy, Economic Development and Construction Act 2009 (LDEDCA 2009). It also flags amendments to the Scheme for Construction Contracts. The HGCRA 1996, in its original form, commenced on 1 May 1998, and the LDEDCA 2009 changes apply to agreements entered into on or after 1 October 2011 in England and Wales. For background and a synopsis of the revisions, see Practice Note: Changes to HGCRA 1996 as at 1 October 2011 [Archived]. Unless stated otherwise, the links in the table below point to the current (ie amended) versions of the HGCRA 1996 and the Scheme for Construction Contracts. For the unamended texts, see Part II of the HGCRA as enacted and the Scheme as enacted. Tracked-change versions are available here:

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
