Applicable law definition

Applicable law describes the body of law that actually governs a dispute, transaction or issue in practice—either because the parties have made a valid governing law (choice‑of‑law) clause, or, absent such a clause, because conflict‑of‑laws rules select it. The term is descriptive rather than a defined statutory label and is used across contracts, tort/delict, property and regulatory compliance. In England & Wales, Scotland and Northern Ireland, if no valid choice is made, the applicable law of contractual obligations is identified under Rome I as retained EU law; for non‑contractual obligations, Rome II as retained EU law applies. This Practice Note considers the Application and Scope of the Contracts (Applicable law) Act 1990 (C(AL)A 1990)

This Practice Note explores how and to what extent the Contracts (Applicable Law) Act 1990 (C(AL)A 1990)-a tailored form of the Rome Convention on the law governing contractual obligations-operates. English courts (the courts of England and Wales) apply C(AL)A 1990 when selecting the governing law for contractual disputes arising from agreements concluded between 1 April 1991 and 16 December 2009. • Decisions of the Court of Justice. For guidance on whether judgments of the Court of Justice are binding on UK courts, see Q&A: Are UK courts and tribunals bound by decisions of the Court of Justice of the European Union...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
