Asbestos definition

What does Asbestos mean? In legal practice, asbestos refers to a group of naturally occurring fibrous silicate minerals present in many pre‑2000 buildings and industrial installations; when disturbed, they release respirable fibres that can cause serious illness, including mesothelioma, asbestosis, lung cancer and pleural thickening. The term is used across health and safety, construction, property and personal injury. It is defined in legislation: in Great Britain by the Control of Asbestos Regulations 2012, in Northern Ireland by the Control of Asbestos Regulations (Northern Ireland) 2012, and in Ireland by the Safety, Health and Welfare at Work (Exposure to Asbestos) Regulations 2006–2010. Health records and medical surveillance

The provisions concerning medical examinations are set out in SI 2012/632, regulation 22, and in the HSE Approved Code of practice (ACOP) L143. Requirements vary according to the kind of Asbestos work undertaken. Under the former regime—the Control of Asbestos Regulations 2006, SI 2006/2739—most ‘low risk’ activities were exempt from mandatory worker medicals. After a complaint to the European Commission that SI 2006/2739 failed properly to implement Directive 2003/18/EC, the UK government agreed to replace the 2006 rules with the Control of Asbestos Regulations 2012 (CAR 2012), SI 2012/632. This created a new category of asbestos work: notifiable non-licensed work.

Licensable work

Licensable work with asbestos is work:

where employees’ exposure to asbestos is not sporadic and is not of low intensity
for which the risk assessment cannot clearly demonstrate that the control limit (0.1 fibres per cubic centimetre of air averaged over a four-hour period) will not be exceeded
on asbestos coating, or
on asbestos insulating board or asbestos insulation for which the risk assessment:
- demonstrates that the work is not sporadic and of low intensity
- cannot clearly demonstrate that the control limit...
