Yes—the disclosure pilot scheme will extend to proceedings already on foot, and not merely newly issued. Accordingly, if your present matter falls within the pilot, the updated Rules will apply from 1 January 2019. The pilot will not disturb any disclosure order made before the pilot’s commencement date, or prior to transfer of proceedings into a Business and Property Court, unless that order is varied or Set aside (see CPR PD 51U, para 1.3).
