Administration order definition

What does Administration order mean? An administration order is a court-managed debt repayment arrangement for an individual judgment debtor: where at least one county court judgment (CCJ) remains unpaid and debts are modest, the County Court, on the debtor’s application, can require a single periodic payment to the court, which distributes it pro rata to creditors and stays enforcement. Effect of administration on LPA Receivership

The appointment of an administrator triggers a moratorium. During this period, a mortgagee is barred from enforcing its security—such as by appointing a receiver—unless the court grants leave or the administrator agrees. For further detail on the administration moratorium, see Practice Notes: The moratorium in administration and Lifting the administration moratorium—appointment of fixed charge receiver.

Where a receiver is already in post and the company subsequently enters administration, a receiver over part of the company’s property must leave office if directed by the administrator. Promontoria (Chestnut) Limited v Craig explored the basis on which administrators may require receivers to stand down; for more, see News Analysis: Administrators’ decision to remove receivers was unreasonable (Promontoria (Chestnut) Ltd v Craig and another).

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
