Article 101 definition

What does Article 101 mean? In practice, Article 101 is the EU competition law rule that bans anti‑competitive agreements and concerted practices—such as cartels, price‑fixing, market‑sharing, bid‑rigging and resale price maintenance—where they prevent, restrict or distort competition and affect trade between EU member States. It covers agreements between undertakings, decisions of associations of undertakings and informal coordination; the test is whether the conduct has an anti‑competitive object or effect. On 29 June 2020, the CMA delivered an infringement decision, concluding Roland (U.K) Limited violated the Chapter I prohibition/Article 101 TFEU through resale price Maintenance, by obliging sales of its electronic drum kits and related components and accessories at or above a set minimum. The objective was to deter retailers from lowering online prices. The CMA levied a penalty a little above £4m, reflecting immunity from a fine between 7 January 2011 and 31 December 2012, a 20% Leniency reduction for 1 January 2013 to 17 April 2018, and a 20% settlement reduction. This sought to restrict retailers from discounting their online prices further.
