What does Environmental permit mean? In legal practice, an environmental permit authorises activities that may pollute air, land or water, or involve waste management. The expression is used across the UK and Ireland; its legal form varies by jurisdiction. Permits impose enforceable conditions (often including BAT), and operating without one where required is a criminal offence. In England and Wales, the Environmental Permitting (England and Wales) Regulations 2016 require a permit for regulated facilities (installations, waste operations, mobile plant, water discharge and groundwater activities), issued by the Environment Agency or Natural Resources Wales, subject to exemptions and standard rules. Under the Environmental Damage (Prevention and Remediation) (England) Regulations 2015, SI 2015/810, and the Environmental Damage (Prevention and Remediation) (Wales) Regulations 2009, SI 2009/995 (EDR), environmental damage is defined as harm to:

a protected species or natural habitat where there is a significant adverse effect on attaining or sustaining the favourable conservation status of the species or habitat
a site of special scientific interest (SSSI) where the integrity of the site is adversely affected
surface water or groundwater where the status of the water body is reduced
