This Practice Note sets out practical guidance on establishing the causal connection between dumped imports and material injury, drawing on the World Trade Organization’s Agreement on the Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 (Anti-dumping Agreement).

Introduction

The WTO Anti-dumping Agreement permits Member States to take unilateral measures and levy anti-dumping duties on specified imported goods. Such unilateral steps are not without constraint, and duties may only be applied where:

  • the Member State has carried out a thorough investigation. For guidance on the investigation process, see Practice Note: Stages in an anti-dumping investigation
