In summary, any organisation with an establishment in the EEA that handles personal data and cannot rely on an exception under Regulation (EU) 2016/679 (EU GDPR) will fall within the EU GDPR’s scope. Organisations lacking a physical presence in the EEA but processing personal data, whether on a regular or occasional basis, should evaluate whether they are likely to be caught by the EU GDPR and/or need to appoint a representative in the EEA.
