This Practice Note outlines, in brief, the European Venture Capital Funds Regulation (EU) 345/2013 (the EuVECA Regulation), as subsequently updated by Regulation (EU) 2017/1991, Regulation (EU) 2019/1156 and Regulation (EU) 2023/2869. The EuVECA Regulation constitutes a specialist alternative investment fund (AIF) regime available to alternative investment fund managers (AIFMs) under the Alternative Investment Fund Managers Directive (2011/61/EU) (AIFMD). The EuVECA Regulation was brought alongside Regulation (EU) 346/2013 on European social entrepreneurship funds (the EuSEF Regulation). The EuSEF Regulation, as amended, falls outside the scope of this Practice Note, but is addressed in Practice Note: The European Social Entrepreneurship Funds (EuSEF) Regulation. On 1 March 2018, Regulation (EU) 2017/1991 amending the EuVECA Regulation and the EuSEF Regulation (the Amending Regulation) took effect. The modifications set out in the Amending Regulation were, among other measures, designed to boost uptake of the elective EuVECA regime, for example by widening the range of managers permitted to market and run EuVECAs to include AIFMs duly authorised...

It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
