This Practice Note outlines the initial actions to be weighed and undertaken for a contempt application within family proceedings under the Family Procedure Rules 2010 (FPR 2010), SI 2010/2955, Pt 37 (commonly called ‘committal proceedings’). It addresses the mandatory formalities before issuing any contempt application, such as (where applicable) the requirement for a penal notice on the order said to be breached, and the requirement for personal service of that order on the defendant. It also reviews the various categories of contempt. A pre-application checklist is provided.
