Client money definition

What does Client money mean? money held or received by a legal practice on behalf of a client, rather than for the firm’s own benefit. It typically includes transaction funds, litigation monies, disbursements and expenses held on account, advances for fees, and sums held as trustee or stakeholder. In practice, client money must be safeguarded, segregated in a client account, accurately recorded and reconciled, and applied, transferred or returned only for the client’s purposes or as required by law. Background to the client money rules

The framework setting out how a firm must protect and manage client money connected to its investment business appears in chapter 7 of the Clients Assets sourcebook (CASS 7), which is part of the Financial Conduct Authority’s (FCA) Handbook. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
