FCA Handbook definition

What does FCA Handbook mean? The fca Handbook is the Financial Conduct Authority’s online rulebook used in UK financial services practice. It compiles binding rules and non‑binding guidance made under the Financial Services and Markets Act 2000 (fsma 2000). Breach of FCA rules may lead to enforcement and, in some cases, a private right of action; guidance is not binding but signals the FCA’s expectations. It is organised into guides and sourcebooks, including high‑level standards (PRIN, SYSC), conduct of business (COBS, MCOB, ICOBS, BCOBS), prudential requirements (MIFIDPRU), supervision and reporting (SUP), fees (FEES), and market materials such as the Listing Rules (LR), Prospectus...

This Practice Note summarises the financial conduct authority (FCA) Handbook, which contains the FCA’s legislative and other provisions made under powers conferred by the Financial Services and Markets Act 2000 (FSMA 2000). It highlights the principal block structure of the Handbook and, while focused on the insurance and reinsurance sector, it also addresses the Handbook’s general features. The structure includes:

  • Regulatory Processes
  • Redress
  • Specialist sourcebooks
  • Listing, Prospectus and Disclosure Rules
  • Handbook Guides
  • Regulatory Guides
  • A Glossary

The FCA Handbook does not include the PRA’s rules. The PRA Rulebook can be accessed here. For further...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
