An application sought to Strike out or summarily dismiss a standalone Abuse of dominance claim issued by Forrest Fresh Foods Limited against Coca-Cola European Partners Great Britain Limited.

Latest development

On 7 September 2021, the CAT delivered its judgment, holding that it was not for the Tribunal to determine what the case might be and that, on the materials available, there was no reasonable basis for the claim. The CAT therefore ordered the claim to be struck out. It also observed that, had the claim not been struck out, it would have been minded to grant Summary judgment in favour of Coca-Cola given the deficiencies identified. The CAT further concluded that the application did not satisfy the threshold for an award of exemplary damages.
