Freezing injunction definition

What does Freezing injunction mean? A freezing injunction stops a respondent from disposing of, dealing with or removing assets to prevent dissipation before trial or enforcement. It is interim relief, typically granted by the High Court, available as a domestic or worldwide freezing order (WFO), and can restrain dealings with assets inside or outside the jurisdiction. Developed by case law (often called a Mareva injunction), it does not confer security over assets. To obtain one, the applicant usually shows a good arguable case, a real risk of unjustified dissipation, assets within the court’s reach, and that relief is just and convenient. This Practice Note sets out advice on preparing a freezing injunction (frequently described as a Mareva injunction or freezing order). It reviews the updated model order for such relief and clarifies why specific provisions and undertakings ought to appear within a freezing injunction. For further clauses you may need to consider, contingent on the court handling your case, consult the principal section headed Court-specific guidance. For insight into the application steps and the criteria the court will use, refer to these Practice Notes:

These resources cover application process and the court’s test for applicants and respondents. For broader assistance on drafting interim injunctions, see Practice Note: Interim injunctions—drafting the order.

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
