District council definition

What does District council mean? A district council is a local authority that administers services for a district. In England, “district” is a statutory term in the Local Government Act 1972: s 270(1) provides it means a metropolitan or non‑metropolitan district, and s 270(2) defines “non‑metropolitan district”. District councils were created by the Local Government Act 1972 and the English Non‑metropolitan Districts (Definition) Order 1972 (SI 1972/2039). In two‑tier non‑metropolitan counties, a district council is the lower tier, typically responsible for housing, planning (as local planning authority, except county matters), waste collection, environmental health, licensing, and as the billing authority for council tax and non‑domestic...

This Practice Note

This Practice Note sets out that determining a highway’s breadth is essentially a matter of fact. Under the common law, there must be evidence amounting to proof of the least width needed to accommodate the traffic entitled to use it. If such proof is absent, the Highways Act 1980 (HiA 1980) specifies minimum and maximum widths as defaults. The Note also outlines the various kinds of boundaries, explaining that there is frequently physical indication of a highway’s lateral limits, yet each instance turns on its own facts. It further notes that, under the HiA 1980, highway authorities may widen a highway, or build fresh bridges or footbridges. Historically, the breadth of a highway seldom gave rise to dispute. The highway right was (and remains) a right to pass and re-pass; a right to travel from A to B...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
