Does the tenant have security of tenure under LTA 1954?

As an initial step, confirm:

  • whether the tenant meets the criteria in LTA 1954, s 23 and holds a statutory entitlement to apply for a new lease when the present tenancy expires, and
  • that the tenancy is not within the excluded categories listed in LTA 1954, s 43
