This Practice Note reviews Fees, advances and Costs under the 2021 International Chamber of Commerce (ICC) Rules of Arbitration (ICC Rules). The ICC Rules apply to any ICC arbitration begun on or after 1 January 2021, unless the parties expressly agree that an older version of the ICC Rules will govern (eg, in the arbitration clause).

Arbitration costs under the ICC Rules

ICC arbitration costs comprise (ICC, art 38):

  • the tribunal’s fees and expenses
  • ICC administrative charges, set by the ICC Court
  • fees and expenses of any tribunal-appointed experts, and
  • the parties’ reasonable legal and other costs
