United States—FTC votes to withdraw Vertical Merger Guidelines and Commentary

On 15 September 2021, under the new leadership of Chair Lina Khan, the Federal Trade Commission held its third open meeting. As anticipated, the FTC voted 3–2, along party lines, to withdraw approval of: (i) the Vertical Merger Guidelines (Guidelines), issued jointly with the Department of Justice (DOJ), and (ii) the FCA’s Vertical Merger Commentary.
