What does Response mean? In construction adjudication, a Response is the responding party’s written case answering the Referral Notice. It sets out the defence on the merits, any jurisdictional objections, set-off and counterclaims, and includes supporting evidence (such as contracts, correspondence, witness statements and expert reports). FORTHCOMING CHANGE:

Further to the Government’s Response to the Ministry of Justice and the Office of the Public Guardian (OPG) Consultation Modernising Lasting Powers of Attorney, the Powers of Attorney Bill received Royal Assent on 18 September 2023, becoming the Powers of Attorney Act 2023 (PAA 2023). When in force, PAA 2023 will bring updates to the Mental Capacity Act 2005 (MCA 2005) to deliver a more modern lasting power of attorney (LPA) service. The changes will include:

  1. introducing regulations so those involved in making an LPA can choose to sign digitally or on paper;
  2. removing attorneys’ ability to register an LPA, so only the donor may register;
  3. introducing regulations setting identification verification requirements for registration applications;
  4. providing a single route for objections to registration via the OPG and widening who can object to include third parties, not just those named in the LPA;
  5. making the OPG, rather than the donor, responsible for notifying named persons that an LPA is being registered.

These reforms aim to modernise processes, enhance safeguards, streamline objections and clarify responsibilities. They will also support digital options while keeping paper available, and strengthen identity checks to reduce fraud and error risks...
