Personal data definition

What does Personal data mean? In data protection practice, personal data is any information that identifies, or could identify, a living person. The term is defined in the UK GDPR and the Data Protection Act 2018 (UK), and in Ireland by the EU GDPR and the Data Protection Act 2018 (Ireland), and is used consistently across the UK and Ireland. A person can be identified directly (for example, by name or an ID number) or indirectly, using data that, alone or with other information reasonably likely to be used by the controller or another person, singles them out (such as location data, online identifiers, or factors...

Practice notes

ARCHIVED: This Practice Note is archived and not maintained. It considered Data protection and Personal data sharing questions arising in cross-border investigations involving US and EU companies prior to the ruling in Facebook Ireland and Schrems (Case C-311/18), where the Court of Justice of the European Union struck down the EU-US Privacy Shield and confirmed that any use of standard contractual clauses (SCCs) must, in practice, provide an adequate level of protection for personal data, following a case by case evaluation of the circumstances of the transfer. This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
