Occupational pension scheme definition

What does Occupational pension scheme mean? In practice, an occupational pension scheme is an employer-backed workplace pension set up to provide retirement (and often death or ill‑health) benefits for employees. It is defined in UK pensions legislation (for example, the Pension Schemes Act 1993 and the Pensions Act 2004) and in Ireland’s Pensions Act 1990, and is typically established under trust by a single employer, a group of employers or an industry-wide provider (including master trusts). THIS PRACTICE NOTE APPLIES TO occupational pension schemeS

This Practice Note sets out the disclosure duties that applied to trustees (or, for contract-based occupational pension schemes, scheme managers) up to 5 April 2014 under the Occupational Pension Schemes (Disclosure of Information) Regulations 1996, SI 1996/1655 (the 1996 Disclosure Regulations). The 1996 Disclosure Regulations were revoked on 6 April 2014 and therefore have no effect after 5 April 2014. In this Practice Note, references to ‘trustees’ are to be read, in relation to a contract-based occupational pension scheme, as including the scheme’s managers. For details of the disclosure obligations for personal pension schemes up to 5 April 2014 under the Personal Pension Schemes (Disclosure of Information) Regulations 1987, SI 1987/1110, see Practice Note: Personal pension schemes—disclosure requirements before 6 April 2014 [Archived]. From 6 April 2014, the disclosure rules for occupational and personal pension schemes were consolidated and harmonised into a single instrument, the Occupational and Personal Pension Schemes (Disclosure of Information) Regulations 2013, SI 2013/2734. For information on the regime applying from 6 April 2014, see Practice Note: Disclosure requirements applicable to occupational and personal pension schemes after 5 April 2014...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
