The lawyer’s role in organising a mediation

Where the parties conclude that mediation is a suitable route to settle their disagreement, or they are bound by a contract requiring them to consider mediation if a dispute arises, or the court directs the parties to consider mediation, responsibility for arranging the mediation at the outset of the process rests with the parties’ legal representatives in practice.

This Practice Note looks at the lawyer’s role in setting up a mediation, including selecting a mediator, arranging the venue, drafting the mediation agreement and determining who will attend, and settling other practicalities as required.
