What does Dependant mean? In pensions law and practice, a dependant is a person who may receive death benefits (a dependants’ pension and/or a lump sum) from a member’s pension scheme because they relied on the member for support. For UK registered pension schemes, the term is defined for tax purposes in the Finance Act 2004 and HMRC guidance: it normally includes the member’s spouse or civil partner; a qualifying child (typically under age 23, or older if dependent due to physical or mental impairment); and any other individual who was financially dependent on, mutually interdependent with, or dependent due to disability...

Types of Death benefits payable

There are two categories of scheme benefits payable when a member dies:

  • pension death benefits
  • lump sum death benefits

Up to 5 April 2015, the pension death benefit provisions in the Finance Act 2004 (FA 2004), s 167, meant a pension death benefit could only be paid to a Dependant of the member for it to be an authorised payment. ‘Dependant’ is set out in FA 2004 Sch 28 Pt 2 para 15. In particular, the following pension death benefits may be provided:

  • a dependant’s scheme pension—payable from a defined benefits arrangement, a money purchase arrangement or a collective money purchase arrangement

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
