Indictment definition

What does Indictment mean? An indictment is the formal document that sets out the offences for which a defendant will be tried in the higher criminal courts (trial on indictment), and it defines the basis for arraignment, the conduct of the trial and the verdict. Elements of the offence of perverting the course of justice

Perverting the course of justice is a common law offence, triable only on Indictment in the Crown Court. The elements are:

  • a person performs acts or embarks upon a course of conduct
  • which has a tendency
  • and is intended
  • to pervert the course of public justice

Acts or embarks on a course of conduct

The offence calls for a positive act, or sequence of acts; mere omission or inaction is not enough (e.g. failing to point out an error). Tendency to pervert

A failed attempt does not bar prosecution, so long as the accused’s behaviour, without any further step by them, created a risk that injustice would follow.

Intention

The prosecution must establish either an intention to pervert the course of justice, or an intention to do an act which, if brought about, would pervert the course of justice...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
