What does NPS mean? NPS (National policy Statement) is the key policy document used in practice to guide applications and decisions on Development Consent Orders (DCOs) for Nationally Significant Infrastructure Projects (nsips). Defined in section 5 of the Planning Act 2008, an NPS sets out the Government’s need case and policy tests for a sector, and carries determinative weight: under section 104 the Secretary of State must decide NSIP applications in accordance with any relevant NPS unless specified exceptions apply (for example, conflict with international obligations or where adverse impacts outweigh the benefits). Where no relevant NPS exists, section 105 applies. NPSs are...

Practice Note

This Practice Note sets out when pre-sentence reports should be obtained and how they are used to support sentencing decisions after conviction in England and Wales. A pre-sentence report (PSR) is ordinarily prepared by the National Probation Service (NPS); for youthful defendants it may instead be produced by a social worker or a youth offending team member. Its purpose is to assist the court in deciding the most appropriate way of dealing with a defendant at the point of sentence.

A PSR is usually provided in writing. It can be delivered orally in court unless the defendant is under 18, or the court is contemplating the imposition of a custodial sentence under specific provisions concerning determinate sentences, extended sentences, and life sentences for young offenders; in those circumstances it must be in writing.

Under the Sentencing Council’s guideline on the imposition of community and custodial sentence, when a community or custodial sentence is being considered the court must request and consider a PSR before reaching a view on sentence, unless it considers that step unnecessary. This requirement is particularly important where the court is considering imposing a custodial term of 12 months or less...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
