Qualification definition

What does Qualification mean? In copyright and performers’ rights, qualification describes the criteria that make a person, corporate body, work or performance eligible for protection in a given jurisdiction. Across England & Wales, Scotland and Northern Ireland, the Copyright, Designs and Patents Act 1988 sets out the tests using the concepts of a qualifying person and qualifying country. SRA SQE Qualifying Work Experience: Requirements, Sign-off, Evidence and Practical Guidance for Employers (England and Wales)

Practice notes
imgtext

From 1 September 2021, a new pathway to Qualification for prospective Solicitors was introduced—the Solicitors Qualifying Examination (SQE). During a transitional period, candidates can still qualify via a training Contract, an apprenticeship, or the SQE. In due course, the SQE will replace the training contract route, and apprenticeship qualification will proceed through the SQE.

To qualify as a solicitor under the SQE, a candidate must:

  • hold a UK degree in any subject (or equivalent qualification or experience—this can include a solicitor apprenticeship)
  • pass both SQE assessments
  • complete two years’ full-time (or full-time equivalent) qualifying work experience (QWE)

The candidate must also meet the SRA’s character and suitability requirements.

This Practice Note sets out the SRA’s rules for QWE and practical points for employers providing training and work experience to aspiring solicitors. For broader information on the SQE, see Practice Note: The Solicitors Qualifying Examination (SQE). For the training contract route, see subtopic: Training contracts. For the apprenticeship route, see Practice Note: Solicitor apprenticeships.

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
