What does Race discrimination mean? In legal practice, race discrimination describes less favourable treatment or conduct because of race, colour, nationality, or ethnic or national origins, in employment, education, goods and services. In England & Wales and Scotland, it is defined and prohibited by the Equality Act 2010, which recognises direct discrimination (including by association or perception), indirect discrimination (a provision, criterion or practice causing particular disadvantage unless objectively justified), harassment related to race, and victimisation for asserting equality rights. The characteristics protected

The Equality Act 2010 (EqA 2010) provides protection against Discrimination and other prohibited conduct relating to certain specified characteristics that individuals may have. Some protections apply solely to one particular characteristic, while others extend equally across all such characteristics, collectively termed the ‘protected characteristics’. ‘Race’ is one of these protected characteristics, with the others being:

  • Age
  • Disability
  • Gender reassignment
  • Marriage and civil partnership discrimination
  • Pregnancy and maternity discrimination
