Responding to the appellant’s notice

When should a response be made?

In the majority of cases where an appellant’s notice exists, the respondent will be required to file a respondent’s notice. If the respondent takes no action, they may rely only on arguments advanced in the lower court, unless the court grants permission. The general approach is that, when acting for the respondent and the lower court has granted permission to appeal, you should begin preparing the respondent’s notice without delay...
