Conditional order definition

What does Conditional order mean? A conditional order is the family court’s provisional order confirming entitlement to dissolve a civil partnership; it does not end the partnership. dissolution takes effect only on the subsequent final order. In England and Wales and in Northern Ireland, the term is statutory (Civil Partnership Act 2004). In England and Wales, from 6 April 2022 it also applies to divorce under the Divorce, Dissolution and Separation Act 2020 (replacing decree nisi). Practice Note

This Practice Note explains when the court may postpone the making of a final order in divorce or dissolution cases started on or after 6 April 2022, following commencement of the Divorce, Dissolution and Separation Act 2020 (DDSA 2020). It also considers applications aimed at blocking the pronouncement of a final order in matters involving religious marriages, and circumstances in which the court, exercising its inherent jurisdiction, may pause the step from conditional order to final order. The Note covers the applicable law and procedure for applications lodged on or after 6 April 2022, being the date DDSA 2020 took effect. For guidance on the position in proceedings issued before 6 April 2022, see Practice Note: Restrictions on decree being made absolute—divorce (pre‑DDSA 2020). This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
