What does Retention mean? In construction contracts, retention is a portion of each interim payment (often 3–5%) withheld by the employer or upstream contractor to secure completion and the remedy of defects. It is a contractual mechanism, not a statutory term, and is widely used across England and Wales, Scotland, Northern Ireland and Ireland in standard forms (e.g. JCT, NEC, PWC). Typically, half of the retention is released at practical completion (NEC: Completion; Ireland PWC: Substantial Completion) and the balance on expiry of the defects liability/rectification period, usually evidenced by a certificate of making good defects or a defects certificate. This Practice Note examines, in particular, the requirements for securing retained and derivative rights of residence under relevant EU free movement Law in the state of residence (the host Member State). The rules governing Retention of a right of residence in the host Member State stem from the rights laid down in Directive 2004/38/EC (the Citizens’ Directive). The rules for obtaining a derivative right of residence in the host Member State arise from the relevant tests under EU law. Switzerland is a party to the Agreement between the EU and the Swiss Confederation, containing free movement provisions that are very similar to, and broadly mirror, those in the Citizens’ Directive.
Non-EU national family Members, whether direct family members or persons whom the host Member State has accepted as durable partners or as other family members, are able to retain their...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
