In July 2022, the now-defunct Department for Business, Energy and Industrial Strategy (BEIS)—whose energy remit has since moved to the Department for Energy Security and Net Zero (DESNZ)—issued a consultation titled Review of Electricity Market Arrangements (2022 REMA Consultation), thereby commencing the Review of Electricity Market Arrangements (REMA). Great Britain’s current electricity market design was put in place to support centralised, fossil fuel-based generation. REMA seeks to pinpoint the changes required to deliver a decarbonised, cost effective and reliable power system by 2035, while safeguarding security of supply, by tackling existing market imperfections and constraints that obstruct this shift. As set out in the 2022 REMA Consultation, the initial remit is expansive, examining potential reforms across all wholesale electricity-related markets and any technologies that do, or could, take part in electricity markets. This spans improving present mechanisms—such as reshaping the Capacity Market to better back renewables—as well as exploring fresh models, including introducing locational pricing in the wholesale market and creating distribution-level markets. It therefore looks across pricing, capacity and participation signals, considering how these can be reshaped to accelerate decarbonisation at least cost, whilst preserving security of energy supply within the evolving electricity system and related markets...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
