This Practice Note outlines the reach of the , established by the Sentencing Act 2020 (SA 2020), which, from 1 December 2020, has stood as the unified, consolidated statute governing the sentencing of criminal offences in the courts of England and Wales. The Sentencing Act 2026, which gained Royal Assent on 22 January 2026, makes extensive amendments to the , revises sentencing powers—including financial orders—broadens the Scope and conditions of community orders and suspended sentence orders, and introduces notable alterations to bail and sentencing principles. It also overhauls elements of release, recall, post-sentence supervision, and the deportation regime for foreign offenders.
