Application definition

What does Application mean? An application is a procedural request asking a court to make an order, typically during the life of proceedings (an interim/interlocutory application) but sometimes disposing of an issue finally. The concept is descriptive rather than statutorily defined; content and procedure are set by court rules and case law in each jurisdiction. England and Wales: under the Civil Procedure Rules, applications are made by application notice (cpr Part 23), on notice or without notice, supported by evidence (usually a witness statement), and subject to filing fees, service and time limits. Service in family proceedings (FPR 2010, SI 2010/2955, Pt 6)

Part 6 of the Family Procedure Rules 2010 (FPR 2010), SI 2010/2955, contains the principal provisions on service in family proceedings. See Practice Note: Service of applications for matrimonial and civil partnership orders within the jurisdiction (pre-DDSA 2020).

For information on service of documents in family proceedings outside the jurisdiction, see:

For information regarding service of documents in financial proceedings, see: Service in financial proceedings. The rules on service within the UK, of documents other than applications for matrimonial and civil partnership orders, are contained in chapter 3 of FPR 2010, SI 2010/2955, Pt 6 (SI 2010/2955, 6.23–6.39), and apply across England, Scotland,...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
