Parental leave definition

What does Parental leave mean? parental leave is time off work, normally unpaid, that an eligible parent (including an adoptive parent) takes to care for a child. In England & Wales and Scotland, and in Northern Ireland, it is a statutory right defined in legislation (Employment Rights Act 1996 and the Maternity and Parental Leave etc. Regulations 1999, with Northern Ireland equivalents). Practice notes

This Practice Note sets out the shared Parental leave framework for births under section 75E of the Employment Rights Act 1996 (ERA 1996) and the Shared Parental Leave Regulations 2014 (SPL Regs 2014), SI 2014/3050. In outline, after a child is born, the mother and one other person — either the child’s father, or an individual who is married to, the civil partner of, or the partner of, the mother — may share up to 50 of the 52 weeks of leave that would otherwise be the mother’s Maternity leave. • the birth of their child
  • adopting a child (refer to Practice Note: Shared parental leave (adoption))
  • obtaining a parental order following a surrogacy arrangement (refer to Practice Note: Shared parental leave (adoption)—Parental order parents)...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
