Immigration Rules definition

What does Immigration Rules mean? In UK legal practice, the Immigration Rules are the detailed criteria and procedures the Home Office applies to decide entry clearance, leave to enter and leave to remain, including the length of leave and its conditions (e.g., work, study, no recourse to public funds). They regulate those who require leave because they lack the right of abode, and set out the practice to be followed in administering the Immigration Act 1971. Made by the Secretary of State under section 3(2) of the Immigration Act 1971, the Rules are laid before Parliament as House of Commons Papers; amendments are issued as Statements...

Practice notes

Practice Note

This Practice Note summarises the guidance documents concerning sponsors of students under the Student and Child Student routes, and sets out the potential statuses a student sponsor may hold. It also addresses key issues around the student sponsor licence and relevant case law. All Students and Child Students must be sponsored by a student sponsor, which the immigration rules define as a sponsor listed on the Home Office register of licensed sponsors.

Since 5 October 2020, sponsors of both Students and Child Students have been called 'student sponsors' (in the Immigration Rules) or 'Student sponsors' (in guidance). Before then, Tier 4 sponsors sponsored Tier 4 (General) and Tier 4 (Child) students. For further information on these changes, see: LNB News 10/09/2020 99. Since then, terminology has evolved, some requirements have become less restrictive, and Legacy sponsorship has ended. Note that all sponsors hold a student sponsor licence, whereas Student Sponsor (both words capitalised) is a status. The use of defined terms is inconsistent throughout the Immigration Rules and guidance...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
