Get definition

What does Get mean? A get is the Jewish religious divorce document, delivered by the husband to the wife under rabbinic supervision (Beth Din). It has no effect on civil marital status: parties still require a civil divorce. However, many clients cannot remarry within their faith without a get, so its availability can be a practical issue in family proceedings. “Get” is not defined in UK or Irish legislation; it is a descriptive term from Jewish law. Civil courts cannot compel a party to grant a get, but they can manage timing of the civil divorce to reduce “get refusal”. In England and...

Practical Time Management for Lawyers: Dealing with Time Bandits, Prioritisation, Procrastination, Efficient Meetings and Work-life Balance

Practice notes
imgtext

Time is an invaluable resource, so learning how to get organised and maximise the hours available to us is an essential skill for everyday modern work and life.

Dealing with time bandits

Time management rests on three core components that guide daily choices:

  • what should I be working on right now?
  • what is standing in my way?
  • what practical action can I take?

If your current approach to managing time isn’t consistently delivering the outcomes you need, you must attempt a different approach.

Then list everything you experience that interrupts or distracts you over the course of a typical day, eg:

  • disorganised filing systems
  • colleagues’ work-related interruptions
  • organisation messaging apps
  • colleagues’ non-work interruptions
  • client phone calls
  • faulty equipment, eg photocopiers etc
  • a cluttered desk...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
