Occupational pension scheme trustees’ employment rights: reasonable paid time off, training, and protection from detriment and dismissal (Great Britain)

Practice notes
imgtext

The Employment Rights Act 1996 (ERA 1996) permits employee trustees of an occupational pension scheme, or directors of trustee companies, to take reasonable paid time away during working hours to carry out their trustee functions, including attending appropriate training. For further information, see: Time off for pension scheme trustees, below. It also grants a right not to be subjected to any detriment by the employer for acting as a trustee of the employer’s scheme (see Trustee protection from detriment, below) and safeguards them from dismissal because they are a trustee of the employer’s scheme, or for fulfilling their trustee duties (see: Trustee protection from dismissal, below). For a sample policy allowing time off for an employee who is a pension scheme trustee, see Precedent: Policy—time off for pension scheme trustees. For guidance on the general right to time off for public duties, see Practice Note: Time off work for public duties.

Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
