Remediation definition

What does Remediation mean? In legal practice, remediation means the steps taken to put right harm, breach or non‑compliance, typically by rectifying defects, removing risks and preventing recurrence. It is a descriptive term used across contexts (e.g. contract, construction, health and safety, data protection), but in environmental law it is grounded in statute. Environmental remediation covers measures to remove, treat, contain or manage pollution or contaminants in soil, groundwater, sediment or surface water to protect human health and the environment, usually to risk‑based standards. In Great Britain, the contaminated land regime under Part IIA of the Environmental Protection Act 1990 enables local authorities (and SEPA...

Regulator power to carry out Anti-pollution works

Section 161 of the Water Resources Act 1991 (WRA 1991) empowers the Environment Agency (EA) and Natural Resources Wales (NRW), as the relevant regulators, to undertake anti-pollution works and operations to investigate, prevent, Remedy and mitigate water pollution.

This authority applies where it appears to the EA or NRW that any poisonous, noxious or polluting substance, or any solid waste, is:

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
