This protocol applies to accidents occurring on or after 31 May 2021 where the injury element of the claim does not exceed £5,000 and the total value is capped at £10,000. The Small claims track limit for personal injury arising from road traffic accidents has been raised to £5,000 for damages for pain, suffering and loss of amenity (PSLA), subject to specified exceptions.
