From 6 April 2026, section 35 of the Employment Rights Act 2025 is brought into force (by regulation 3 of The Employment Rights Act 2025 (Commencement No. 2 and Transitional and Saving Provisions) (Amendment) Regulations 2026, SI 2026/323). It obliges employers to maintain records sufficient to demonstrate, and adequate to show, whether they have complied in full with the entitlements in regulations 13(1) (annual leave), 13A(1) (additional annual leave), 15B(2) (annual leave for irregular and part-year Workers) and 16(1) (holiday pay), and with the requirements in regulations 14(2) (payment in lieu of annual leave), 14(6) (payment in lieu of annual leave) and 15E(2) (payment in lieu of annual leave for irregular and part-year workers) of the Working time Regulations 1998 (WTR 1998), SI 1998/1833, and to retain those records for six years from the date of creation by employers.
